Social Networks: Macron Calls on the EU to Ban Access for Under-15s

The French president wants to harmonize at the European level a measure that France was unable to implement. In August, the Constitutional Council struck down the national provision adopted by Parliament, considering that the planned restrictions constituted a disproportionate infringement on the freedom of expression and communication of adolescents.

Emmanuel Macron nevertheless maintains his objective. He says he wants to present a revised French text in the autumn, in accordance with European Union law and the Constitution, while asking Brussels to build a common framework for the twenty-seven member states.

The request addressed to Ursula von der Leyen goes beyond a simple age threshold. Paris also wants the future European framework to more clearly regulate certain features considered addictive and to be able to impose default safety standards, including limits on usage time.

The President of the Commission had already announced that Brussels would present proposals on minors’ access to social networks after the summer. She mentioned a gradual approach based on age groups, while France advocates for a uniform ban before the age of 15.

Paris relaunches its offensive after the censorship

The issue has become one of the digital priorities of the Élysée. In April, Emmanuel Macron reaffirmed his commitment to banning social networks for those under 15 during a day dedicated to youth disconnection in Villers-Cotterêts.

The French Parliament had already voted in January in favor of a ban on social networks for those under 15 years old. The constitutional censorship now requires the executive to precisely redefine the scope of the measure and the protections provided to minors.

A regulation that extends beyond France

Several governments are simultaneously seeking to strengthen control over platforms. In Australia, a new proposal notably plans to give internet users the option to disable personalized algorithmic recommendations, following the adoption of specific restrictions for minors.

At the European level, the issue should now shift towards the timing and scope of a potential common text. A ban at the Union level would require specifying the methods for age verification, the obligations imposed on platforms, and the safeguards for the protection of personal data.
