
In point 15 of its 5th report, the United Nations asked Senegal to legalize homosexuality, reports senenews.
In Senegal, homosexuality is criminally punished as an indecent assault and is legally qualified as an “indecent or unnatural act with an individual of the same sex”. But the UN wants the Senegalese state and its people to adopt a different stance that is more open to homosexuals. Indeed, in point 15 of its 5th report, the world’s leading organisation made its appeal to Macky Sall’s country: “The State Party (Ndr Senegal) should take concrete and urgent measures to address the current campaign of hate speech against people on account of their sexual orientation and persons defending their rights, including partner organisations involved in the fight against HIV/AIDS”, the report states.
It therefore demanded that Senegal “repeal Article 319.3 of the Criminal Code, which criminalizes sexual acts between consenting adults of the same sex, with a view to reducing the stigmatization of the concerned persons “.
Homosexuality is punishable in Senegal under article 319, paragraph 3, of the Senegalese Penal Code, which was enacted by Act No. 66-16 of 12 February 1966: “Anyone who commits an indecent or unnatural act with an individual of his or her sex shall be punished by imprisonment for one to five years and a fine of 100,000 to 1,500,000 francs. If the act was committed with a minor under 21 years of age, the maximum penalty shall always be imposed.
